Typically – yes, if the employee is entitled to Redundancy Pay, the employer will be required to pay both Redundancy pay and Notice of Termination based on their length of service.
Generally an employer would be required to pay ‘Redundancy Pay’ if redeploying an employee to a lower paid job.
Typically the employee would work the ‘Notice of Termination’ period in their new job if redeployed.
Special Request to the Fair Work Commission
Under special circumstances the Employer may request the Fair Work Commission to vary the amount of Redundancy pay typically payable.
The employer would need to make this request on the following form Form F45A.
